3. Account and Information
- Investors must provide accurate, complete, and current information.
- KCE Capital may verify identities and reject access for non-compliance.
4. Fees and Expenses
- Management and performance fees are outlined in your investment agreement.
- Fees may change; all updates will be communicated officially.
5. Intellectual Property
- All materials provided by KCE Capital are protected.
- No part of the materials may be copied or distributed without prior written consent.
6. Limitation of Liability
- KCE Capital is not liable for losses from trading activities, market volatility, operational failures, or cybersecurity breaches.
- Investors bear full responsibility for outcomes.
7. Indemnification
- Investors agree to indemnify and hold KCE Capital and its affiliates harmless from any claims, damages, or losses arising from their actions or violations of these terms.
8. Governing Law
- These TOS are governed by the jurisdiction specified in your investment agreement.
- Disputes will be resolved via arbitration or courts of competent jurisdiction.
9. Amendments and Termination
- KCE Capital may amend TOS at any time; material changes will be communicated.
- Access may be suspended or terminated for non-compliance, without relieving investors of prior obligations.
10. Acknowledgment
By accessing or investing with KCE Capital, you confirm that you:
- Have read and understood these Terms of Service.
- Agree to be bound by them.
- Accept full responsibility for all interactions with the Fund.
